01 About us
Picknsave Ltd ("we", "us", "our", or "Picknsave") is a company registered in England and Wales. We trade under the brand "Pick N Save" and operate "The Food Supply" — our wholesale and direct-to-consumer catalogue, the Pick N Save Inventory Management Platform (PIM), and related distribution and sales operations across the United Kingdom.
These Terms of Service ("Terms") apply when you browse our sites, register for an account, place an order, supply goods to us, or otherwise interact with our services. By using our services you accept these Terms in full. If you do not accept them, please do not use our services.
02 Definitions
- Goods
- Any products supplied, sold or distributed by us, including those listed on The Food Supply catalogue.
- Customer
- A retail buyer purchasing Goods through our ecommerce store for personal or household use.
- Wholesale Buyer
- A registered business buying Goods from us in bulk for resale or commercial use, under credit or proforma terms.
- Supplier
- A third party who manufactures, imports or otherwise supplies Goods to Picknsave for distribution.
- Sales Agent
- An authorised representative of Picknsave conducting field sales on our behalf.
- Order
- A request to buy Goods placed via the website, by phone, by email or through a sales agent.
- Contract
- The binding agreement formed when we confirm acceptance of your Order.
- Working Day
- Any day other than Saturday, Sunday or a public holiday in England and Wales.
03 Your account
Some of our services require an account. You must provide accurate, current and complete information when registering and keep it up to date. You are responsible for all activity that takes place under your account.
Eligibility
- You must be at least 18 years old to register.
- Wholesale accounts must be in the name of a UK-registered business with a valid company number.
- Supplier accounts require approval following onboarding checks (including company verification and, where applicable, food safety documentation).
Account security
Keep your password confidential. Notify us immediately at [email protected] if you suspect unauthorised use. We may suspend or terminate accounts that show signs of compromise or misuse.
Two-factor authentication
Staff and admin accounts are required to enable two-factor authentication. We recommend that wholesale buyers and suppliers also enable it from the security settings in their account.
04 Wholesale terms
These terms apply to Wholesale Buyers purchasing Goods for resale or commercial use. They sit alongside any individual contract or Supplier-Buyer Agreement we have with you.
Pricing & quotes
- Wholesale prices are confidential and may be customer-specific based on volume, payment terms, customer type or contracted discount.
- Quotes are valid for 14 days unless otherwise stated and are subject to product availability and pricing at the time of order acceptance.
- All prices are in pounds sterling (GBP), exclusive of VAT unless explicitly stated.
Minimum order quantity (MOQ)
- Standard MOQ is £250 ex-VAT per order, subject to product-specific case sizes.
- Bespoke MOQs may apply to certain categories (e.g. frozen, fresh produce, bulk dry goods).
- Orders below MOQ may be subject to a small-order surcharge or declined.
Credit accounts
- Credit terms are offered at our discretion following a satisfactory credit check.
- Standard credit terms are 30 days net from invoice date unless otherwise agreed in writing.
- We may reduce, suspend or withdraw credit at any time with immediate effect if your account becomes overdue, your credit profile deteriorates or there is any change in control of your business.
- Late payments accrue interest at the statutory rate under the Late Payment of Commercial Debts (Interest) Act 1998.
Order confirmation
Placing an Order does not create a Contract until we have confirmed acceptance, typically by email confirmation containing the agreed price, quantities and delivery window. We reserve the right to reject any Order, including for stock, credit or logistical reasons.
05 Distribution & delivery
We distribute Goods across mainland UK from our own fulfilment network and approved third-party carriers. Lead times and delivery methods depend on the Goods, your location and your account terms.
Delivery windows
- Standard wholesale delivery: 2–4 Working Days from order confirmation.
- Scheduled deliveries follow your agreed cadence (e.g. fixed weekly, bi-weekly, ad-hoc).
- Ecommerce retail delivery: typically 2–5 Working Days; estimated dates are displayed at checkout.
- Express and same-day services are available in selected postcodes at an additional charge.
Booked delivery slots
- Wholesale Buyers and Suppliers can self-serve delivery slot bookings via the PIM platform.
- Slot reschedules require at least 24 hours' notice (or 2 hours for urgent moves) and are subject to dock capacity.
- No-shows or missed slots may incur a re-delivery fee and impact your future allocation.
Carriage & charges
- Delivery charges are stated at checkout or in your wholesale account terms.
- Free delivery thresholds, where they apply, are calculated on the order's net VAT-exclusive value.
- Pallet, frozen and ambient deliveries may attract different charges; quoted separately.
Risk & title
- Risk of loss or damage in the Goods passes to you upon delivery to the address specified in the Order.
- Title in the Goods remains with us until we have received cleared payment in full, including any VAT and delivery charges.
- Until title passes, you must store the Goods separately, keep them identifiable as our property, insure them against loss, and not resell them other than in the normal course of business.
Inspection on receipt
Please inspect Goods on delivery. Any shortages, damage in transit or wrong items must be reported on the delivery note and notified to us within 48 hours of receipt. Claims raised after this window may not be accepted.
06 Sales, returns & refunds
Cancellation
- Consumers ordering through our ecommerce store have the right to cancel within 14 days of receipt for most Goods, in line with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
- This right does not apply to perishable Goods (e.g. fresh produce, dairy, bakery), sealed Goods opened after delivery, or bespoke/personalised items.
- Wholesale Buyers may not cancel a confirmed Order without our written agreement.
Returns
- Goods returned under the consumer cancellation right must be unopened, unused and in their original packaging.
- You are responsible for the cost of return unless the Goods are faulty, damaged on arrival or not as described.
- Wholesale returns require a Return Material Authorisation (RMA) issued by us and follow your account-specific returns policy.
Refunds
- Approved refunds are processed within 14 days of receiving the returned Goods (or evidence that you have sent them back), to the original payment method.
- We may reduce a refund to reflect any reduction in value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the Goods.
Faulty & damaged Goods
If Goods you receive are faulty, damaged or not as described, please contact us as soon as reasonably possible. Where the fault is confirmed, we will repair, replace or refund the Goods as we may elect, in line with your statutory rights under the Consumer Rights Act 2015 (for consumers) or the Sale of Goods Act 1979 / Supply of Goods and Services Act 1982 (for business buyers).
07 Ecommerce & the website
Catalogue accuracy
- We take reasonable care to ensure product information, images, weights and prices on The Food Supply catalogue are accurate.
- Images are illustrative only — packaging, labelling and case configuration may vary.
- Despite our best efforts, products may occasionally be mispriced. If a pricing error is obvious and would have been recognisable as such, we are not obliged to fulfil the Order at the incorrect price.
Placing an order
- You add Goods to your cart and proceed to checkout.
- You confirm your delivery and payment details and submit your Order.
- We send an Order acknowledgement, which is not yet acceptance.
- The Contract is formed when we email you to confirm dispatch (or otherwise accept your Order).
Stock availability
Stock status is shown on the catalogue and updated in near real time. We do not guarantee that all listed Goods will always be available; if we cannot fulfil all or part of your Order, we will contact you and refund the affected amount.
Acceptable use of the website
You agree not to:
- scrape, crawl or harvest the catalogue for commercial purposes without our written permission;
- attempt to gain unauthorised access to any part of our systems;
- upload viruses, malicious code or content that is unlawful, defamatory or infringes any third party's rights;
- use any automated tools (bots, scripts, etc.) to interact with our checkout or account systems.
08 Supplier obligations
If you supply Goods to Picknsave, the following obligations apply in addition to any separate Supplier Agreement we have signed with you.
Quality & compliance
- All Goods must be of satisfactory quality, fit for purpose, and conform to the specifications agreed with us.
- Food and drink Goods must comply with all applicable UK food safety, labelling and traceability laws, including the Food Safety Act 1990 and the Food Information Regulations 2014.
- You warrant that you hold all necessary licences, certifications and approvals to supply the Goods to us.
Catalogue uploads
- Product data, images and prices uploaded via the PIM must be accurate, current and free from third-party rights infringement.
- We may reject, hide or remove any listing that does not meet our standards.
Recalls & withdrawals
- You must notify us immediately on becoming aware of any safety issue, quality defect or regulatory action affecting Goods you have supplied.
- You will cooperate fully and cover all reasonable costs of any resulting recall or withdrawal.
Delivery to us
- You must deliver to your booked slot and follow our dock procedures.
- Goods must be palletised, labelled and packed in line with our receiving standards.
- We may reject any delivery that is late, damaged, mis-labelled or non-conforming, at your cost.
09 Prices, payment & VAT
Prices
- All retail prices on the ecommerce store are shown inclusive of VAT, where applicable.
- Wholesale prices are quoted exclusive of VAT and clearly marked as such.
- We reserve the right to update prices at any time. Confirmed Orders are honoured at the price agreed at the time of confirmation.
Payment
- Retail Orders are paid in full at checkout via the payment methods listed on the site (e.g. card, Apple Pay, Google Pay).
- Wholesale Orders are paid by bank transfer, direct debit or under agreed credit terms.
- We may pre-authorise your card to verify payment details and protect against fraud.
VAT & invoices
- VAT is charged in accordance with HMRC rules and shown clearly on every invoice.
- Tax invoices are available in your account portal or, on request, by email.
- Where you are eligible for zero-rating, exemption or reverse charge, please provide the relevant evidence on order.
10 Warranties & liability
Our warranty
We warrant that the Goods will, on delivery, conform to their description and be of satisfactory quality. Nothing in these Terms limits or excludes your statutory rights as a consumer under the Consumer Rights Act 2015.
Limitation of liability (business buyers)
- Our total aggregate liability arising under or in connection with the Contract, whether in contract, tort (including negligence), breach of statutory duty or otherwise, shall not exceed the price paid by you for the Goods giving rise to the claim.
- We are not liable for any loss of profit, loss of business, loss of revenue, loss of goodwill, loss of anticipated savings, or any indirect or consequential loss.
- Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under English law.
11 Intellectual property
- The Pick N Save name, "The Food Supply" name, our logos, the PIM platform, and all related content (text, images, software, code, design) are owned by or licensed to us and protected by intellectual property laws.
- You may not copy, reproduce, modify, distribute or commercially exploit any of our content without our prior written consent.
- Where you upload content to our platform (e.g. supplier catalogues), you grant us a worldwide, royalty-free, non-exclusive licence to use that content for the purpose of operating our services.
12 Data & confidentiality
Personal data we collect is handled in line with our Privacy Policy and applicable data protection law, including the UK GDPR and Data Protection Act 2018.
Each party will keep confidential all non-public information disclosed by the other party, including pricing, customer lists, product roadmaps and commercial terms, and will use it only for the purpose of performing the Contract.
13 Force majeure
Neither party will be liable for any failure or delay in performing its obligations where caused by events beyond its reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, pandemic, government action, strikes, fire, flood, transport disruption, or supplier failure. The affected party will notify the other promptly and resume performance as soon as reasonably practicable.
14 Termination
- You may close your account at any time by contacting us at [email protected].
- We may suspend or terminate your access immediately if you materially breach these Terms, become insolvent, or fail to pay any sum due to us within 14 days of the due date.
- Termination does not affect any rights or obligations that accrued before termination, including any unpaid invoices.
15 General & governing law
Variations
We may update these Terms from time to time. The current version will always be available at this page, with the "Last updated" date at the top of the hero. Material changes will be notified to active account holders by email.
Assignment
You may not assign or transfer your rights under these Terms without our written consent. We may assign or transfer ours, including in connection with a sale of part or all of our business.
Entire agreement
These Terms, together with any documents expressly referred to in them and any separate written agreement we have with you (e.g. a Supplier Agreement or Credit Account Application), constitute the entire agreement between you and us in connection with their subject matter.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Governing law & jurisdiction
These Terms and any dispute arising out of or in connection with them are governed by English law. The courts of England and Wales have exclusive jurisdiction, except that consumers resident in Scotland or Northern Ireland may bring proceedings in their local courts.
